Willow Street Water Main Replacement
INVITATION TO BID
Sealed bids for the construction of Water Main Replacement in Willow Street, Peaks Island, Portland will be received by the Portland Water District, 225 Douglass Street, Portland, Maine until 2:00 p.m. local time, August 19, 2010. The work shall consist of, but is not necessarily limited to, the following:
Replace approximately 730 feet of existing water main in Willow Street and the right-of way between Willow Street and Lower A Street with new 8-inch diameter ductile iron water main and appurtenances.
2. Furnish and maintain temporary water systems where indicated on the drawings..

Each proposal must be accompanied by Proposal Guaranty in form of certified check or bid bond in amount of five percent (5%) of the total amount of the bid. A performance bond in an amount equal to one hundred percent (100%) of the contract price, and labor and material payment bonds in like amount will be required prior to execution of the Agreement.
Bidder must comply with all rules and regulations associated with the municipal street opening ordinances.
Bidder agrees to commence work on or after the date specified in the Notice to Proceed, to achieve substantial completion of work on within 45 days of the date specified in the Notice to Proceed and final completion of all work within 60 days of the date specified in the Notice to Proceed. If substantial completion of work is not achieved by the date specified in the Notice to Proceed, the Bidder further agrees to pay as liquidated damages, the sum of $250.00 for each consecutive calendar day until substantial completion is achieved.
No bids may be withdrawn within sixty (60) days after date of opening thereof. Right is reserved to refuse or reject any or all bids or to waive any informality in proposals received and to award work at discretion of the General Manager acting in the best interests of the Portland Water District

Southern Cape Elizabeth Wastewater Treatment Facility and Spurwink Pump Station
Phase 1 Upgrade
Sealed bids for construction of Southern Cape Elizabeth Wastewater Treatment Facility and Spurwink Pump Station Phase 1 Upgrade will be received by the Purchasing Agent in the Nixon Training Center at the Portland Water District main office at 225 Douglass Street until 1:00 P.M., local time, August 3, 2010 and then at said office publicly opened and read aloud. Bids submitted after this time will not be accepted. Each bidder must submit a single sealed envelope, the outside of which must be clearly marked "Bid for Southern Cape Elizabeth Wastewater Treatment Facility and Spurwink Pump Station Phase 1 Upgrade ".
The work includes, but is not limited to:
1) Upgrade to the Spurwink Pump station, including but not limited to, the following:
a) Demolition of:
1. Influent and bypass pumps and associated piping and appurtenances.
2. Section of influent sewer to the wet wells.
3. Electrical switchgear, conduit and wire.
4. Existing electrical service feed.
b) Construction of:
1. New submersible influent dry weather pumps.
2. New dry pit submersible influent wet weather pumps.
3. New submersible bypass pumps.
4. New internal piping, valving and field instrumentation.
5. New site piping modifications including influent sewer and force main bypass piping.
6. New precast concrete flow meter/valve vault.
7. New electrical switchgear, conduit and wire.
8. New electrical service entrance.
9. Reconfiguration of existing emergency generator to serve the pump station only.
10. Modifications to the pump station controls and fiber optic connection to WWTF control system.
11. New 6" ductile iron force main between Spurwink pump station and the Southern Cape Elizabeth wastewater treatment facility.
2) Upgrade to the Southern Cape Elizabeth WWTF, including but not limited to the following:
a) Demolition of:
1. Existing bar rack
2. Existing 12" clarifier effluent piping in the yard
3. Existing 6" RAS piping in yard
4. Effluent and waste activated sludge/return activated sludge pumps and piping
5. Existing electrical feed service
b) Construction of:
1. New 20" clarifier effluent line in the yard
2. New 8" RAS piping in the yard
3. New mechanical bar screen and wash press if Bid Alternates are selected.
4. New return activated sludge forcemain between the pumps and oxidation ditch flow splitter
5. New effluent dry weather pumps
6. New wet weather effluent pumps
7. New waste activated sludge/return activated sludge pumps
8. New effluent forcemain bypass line
9. New polymer feed system
10. New field instrumentation, PLC-based control panel and Plant SCADA system.
11. New electrical service entrance
12. New emergency generator for plant loads only.
Completion time for the project will be 360 calendar days for substantial completion and 410 calendar days for final completion.

The Issuing Office is Wright-Pierce, 99 Main Street, Topsham, Maine 04086. Copies of Contract Documents may be obtained upon payment of a fee of $125.00 per set. Partial sets will not be distributed. All requests for mailed documents must be accompanied by an additional non-refundable fee of $25.00 to cover postage and handling. Checks should be made payable to WRIGHT-PIERCE. Credit cards will not be accepted.
To be considered a responsive Bidder, the Contractor shall have obtained at least one set of paper plans and specifications from the Engineer (Wright-Pierce). The Bid will not be awarded to a Bidder unless a record for the purchase of at least one set of paper plans and specifications exists in the office of the Engineer. To meet this requirement and to establish the record of purchase, a prospective Bidder must purchase paper plans and specifications using the name that is to appear in the Bid Documents.
A mandatory pre-bid conference will be held for General Contractors at the Cape Elizabeth wastewater treatment facility at Spurwink Avenue in Cape Elizabeth on July 20, 2010 at 9:00 A.M. Attendance by Subcontractors, while encouraged, is not mandatory.
A completed Bid Form, Experience Statement and Executive Order 11246 Compliance Statement must be submitted with the Bid. In addition, a certified check or bank draft payable to the OWNER or a satisfactory Bid Bond executed by the Bidder and a Surety Company in the amount equal to five percent (5%) of the Bid shall be submitted with each bid. No Bid may be withdrawn for at least 60 days after receipt of Bids unless released by the Owner. The Surety Company or the bank must be authorized to do business in the State of Maine. Bids submitted without Bid Security will not be considered.
The apparent low bidder must furnish, within 10 days after the receipt of Bids, completed EPA Forms 6100-4 - DBE Program Subcontractor Utilization Form and 6100-3 - DBE Program Subcontractor Performance Form (Section 00800, SC-20). Within five days after the receipt of bids, Contractor shall deliver to the Engineer and Owner for review and acceptance the listing of subcontractors, suppliers or entities for the work listed in Supplementary Condition SC-6.06.
The successful bidder must furnish, within 10 calendar days after the Notice of Award, the required number of copies of the signed Agreement, plus a Certification of Non-Segregated Facilities, 100% Performance Bond, 100% Payment Bond, and begin execution of this contract within 10 calendar days following the Notice to Proceed.
Any awarded contract is expected to be funded, in part, by a State Revolving Loan. Neither the State of Maine nor any of its departments, agencies, or employees is or will be a party to this Agreement. The word “AGENCY” in the standard general conditions and the owner-contractor agreement refers to the Maine Department of Environmental Protection, if it is the sole funding agency.
The Successful Bidder must comply with the following:
Disadvantaged Business Enterprises (DBE) Program:
Each bidder shall take special notice of the goals for use of Disadvantaged Business Enterprises Minority and Woman Business Enterprises in sub agreements. Failure to complete the requirements of this program may result in finding that the bidder is non responsible and therefore, not entitled to award of this contract. Complete requirements are detailed in the Bid Documents.
Non-discrimination in Employment and Labor Standards: Bidders on this work and all subcontractors will be required to comply with the President's Executive Order No. 11246 (EEO) and the amendments and supplements to that Order regarding affirmative action and equal employment opportunity. A Compliance Certification Form is required with bid (Section 00406). Requirements under this Order are detailed in the Bidding Documents.
Department of Labor Regulations: The Contractor must comply with all the Safety and Health Regulations (CFR29 Part 1926 and all subsequent amendments) as promulgated by the US Department of Labor on June 24, 1974; the Department of Labor Regulations relating to Copeland "Anti-Kickback Act (18 U.S.C. 874) as supplemented by 29 CFR Part 3; Contract Work Hours and Safety Standards Act (40 U.S.C. 327-330) as supplemented by 29 CFR Part 5, and Occupational Safety and Health Standards (OSHA) (29 CFR Part 1910).
Environmental Regulations:
The Contractor must comply with all applicable standards, orders, or requirements issued under Section 306 of the Clean Air Act (42 U.S.C. 1857(h)), Section 508 of the Clean Water Act (33 U.S.C. 1368), Executive Order 11738 and Environmental Protection Agency regulations (40 CFR Part 15). Contractors are urged to become familiar with the requirements of these regulations.
Federal Wage Rates:
Federal Wage Rates apply to this contract. Contractors are urged to become familiar with the requirements of these regulations.
The contractor must comply with Davis-Bacon (D-B) and Davis Bacon Related Acts (DBRA) as stated in the CWSRF Supplementary Conditions. All laborers and mechanics employed by the contractor and subcontractors on this project shall not be paid less than the prevailing wage rates contained in the wage determination published in the bidding documents. Any laborers and mechanics not listed in the wage determination shall be paid at least as much as the lowest wage rate for other similar trade classifications already contained in the wage determination published in the bidding documents.
The Owner reserves the right to reject any or all Bids, to waive any technical or legal deficiencies, and to accept any Bid that it may deem to be in the best interests of the Owner.

No bids may be withdrawn within sixty (60) days after date of opening thereof. Right is reserved to refuse or reject any or all bids or to waive any informality in proposals received and to award work at discretion of the General Manager acting in the best interests of the Portland Water District.

Any contract awarded under this Invitation to Bid is expected to be funded in part by a State Revolving Fund (SRF) loan. Neither the State of Maine nor any of its departments, agencies, or employees is, or will be, party to the Contract.
Any person interested in Bidding on the Contract must become thoroughly familiar with the Maine EPA SRF Supplemental General Conditions. Failure to comply with any of these conditions may result in the Bidder not being eligible for the award of this Contract.
Minority and Women Business Enterprise Requirements
Each Bidder shall take special notice of the Guidance for use of Minority and Women Business Enterprises in the SRF Supplemental Conditions (Executive Order 11432). Failure to complete these requirements may result in finding that the Bidder is non-responsive and therefore not eligible to be awarded this Contract. Nondiscrimination in Employment and Labor Standards
Bidders on this work will be required to comply with the President’s Executive Order No. 11246 and amendments and supplements to that order. The requirements for Bidders and Contractors under this Order are located in the Information to Bidders.
Federal Requirements
The Contractor must comply with: the Department of Labor Relations relating to the Copeland “Anti-Kickback” Act (18 U.S.C. 874) as supplemented by 29 CFR part 3; the Contract Work Hours and Safety Standards Act (40 U.S.C. 327-330) as supplemented by 29 CFR part 5; and the Occupational Safety and Health Standards (OSHA) (29 CFR part 1910).
The Contractor must also comply with all applicable standards, orders, or requirements issued under Section 306 of the Clean Air Act (42 U.S.C. 1857(h)), section 508 of the Clean Water Act (33 U.S.C. 1368), Executive Order 11738, and the Environmental Protection Agency regulations (40 CFR Part 15
